General terms and conditions

  1. Scope of application

The general terms and conditions (hereinafter referred to as “GTC”) apply to all legal transactions concluded via the online store on AVIELLEMUSIC.COM (hereinafter referred to as “online store”). This online store is managed by Avielle Bucher (hereinafter referred to as “AVIELLE”). AVIELLE reserves the right to change these terms and conditions at any time. The version valid at the time of the order is always authoritative. This can be viewed at https://aviellemusic.com/gtc.

  1. Offer

The products and prices in the online store are considered as an offer. The offer is valid as long as the product can be found in the online store and is in stock.

  1. Products and prices

AVIELLE can freely set the prices and change them at any time. When ordering, the price published on the website is authoritative. If prices have been published in error, AVIELLE reserves the right to inform the buyer before shipment in order to agree on a price correction or to cancel the order. Prices are quoted in CHF by default. The shipping and packaging costs are included in the indicated price by default. If this is not the case, they will be shown separately. Any cash on delivery charges of the logistics partner or customs duties shall be borne in full by the customer.

  1. Information provided

AVIELLE makes every effort to keep the published data in the online store up to date and correct. However, errors may occur due to sales through other channels. Therefore, all information regarding availability and delivery time is without guarantee and may change at any time.

  1. Conclusion of contract

The purchase contract is concluded by sending (online) the order and acceptance by AVIELLE. Prerequisite for a valid purchase contract is the complete and truthful completion of the order form provided on the online store and the acceptance of these General Terms and Conditions. AVIELLE confirms the receipt of the order with an automatically generated order confirmation by e-mail. This only indicates to the customer that the order has been received and that the contract of sale has been concluded, subject to the possibility of delivery and the correct quotation of the price.

  1. Terms of delivery
    1. Availability and delivery

Physical products marked as “available” will normally be shipped within 0 – 3 business days between Monday and Friday from the time the order is received. There is no shipping on Saturdays and Sundays. If a product is out of stock or incorrectly marked as “available”, the customer will be notified by email and a new provisional delivery date will be arranged.

If an item is no longer available, AVIELLE may withdraw from the contract, but must fully refund the customer for any payments already made for the product in question.

If AVIELLE is not able to provide or ship the items within 30 calendar days from receipt of the order, the customer has the right to withdraw from the contract. Payments already made by the customer to AVIELLE for the product in question will be refunded in full. There are no further claims against AVIELLE.

If additional shipping costs are incurred due to an incorrect delivery address or incorrect address data, these costs shall be borne in full by the customer. Unless otherwise agreed, AVIELLE sends national and international orders by Swiss Post. The terms, information and delivery times of the Swiss Post apply.

Please note that AVIELLE is not responsible for customs or duties imposed by the country of destination. Customers can contact AVIELLE in writing via email (hello@aviellemusic.com) or Instagram DM.

    1. Additional provisions Delivery

If the Customer does not accept the goods delivered by the supplier within the agreed or stated delivery times, AVIELLE may withdraw from the contract, cancel the order and charge the Customer a handling fee of 15%, but at least CHF 30.

  1. Duty of inspection

The delivered products are to be checked by the buyer immediately after acceptance for completeness, correctness and delivery damage. If there is a defect, this must be reported to AVIELLE within 7 calendar days. The product must be in its original condition to be taken back.

  1. Warranty conditions and services

The Swiss statutory warranty provisions apply according to Art. 197 ff. OR. A warranty claim can only be asserted by the customer upon presentation of the purchase contract including the valid order form. There is no warranty claim for damage due to improper handling or defects that are due to external influences. This could be, for example, elementary damage, moisture damage, drop and impact damage or damage due to modifications. AVIELLE can provide warranty service by replacing the product.

  1. Liability and disclaimer

AVIELLE is only liable for the warranty services listed in section 8. Any further liability is excluded, in particular liability for damage not caused to the products themselves. These can be indirect and consequential damages. Furthermore, AVIELLE is not liable for damages caused by improper storage or use.

  1. Payment

The invoice for the goods is to be paid in the currency indicated therein and immediately at or after sending the order. Credit Card is accepted as payment method in the online store.

  1. Right of withdrawal and cancellation

Orders of digital as well as physical products cannot be returned, exchanged or cancelled. If problems arise or the ordered product does not meet the expectations, the customer can contact AVIELLE in writing. A solution will be sought bilaterally.

  1. Data protection

AVIELLE only collects personal data that is necessary for the conclusion of the contract. These will not be processed without the separate consent of the buyer. The data will only be disclosed to third parties if this is necessary for the processing of the order. This concerns the logistics partner (e.g. post office, DHL, etc.) in the case of a home delivery and the credit institution in the case of payment processing.   1. Legal application

The relationship between AVIELLE and the customer is governed exclusively by Swiss law.
